if an employee is pregnant and delivers a child but loses it, do we have to consider it for abortion leave or maternity leave ??

Missed abortion – it’s the case where the fetus where the heart beat stops in any number of days ( 4 weeks – 37 weeks) before due date of delivery.

According to the Maternity Benefit Act in case of miscarriage or medical termination of pregnancy, a worker is entitled to six weeks of paid maternity leave, Yes she will get the benefits for 6 weeks
If delivery happened then it can not be termed as miscarriage – Death happened after delivery. In this scenario Maternity Benefit leave will be applicable as per the rules.
If miscarriage happens just in 8weeks, still women employees gets the leave for 6weeks ?
Firstly, Pl try to get the new born, documents for your back up., Secondly, as you confirmed baby birth., You can split the payment benefit into two. Before delivery 3 month and After delivery 3 month. This is as per the act. So you can make a payment for 3 month. And post delivery payments can be covered till the babies last day

I would like you all to be informed do check with your corporate Mediclaim policy, most of the insurance company doesn’t take miscarriage into account and employees will not get any benefits. They will be left alone to bear the hospital expenses in urgency
if the fetus is 8 weeks & above due to unwanted incident miscarriage happens, employee/dependent will have to go through D&C. An extra pain of expenses where insurance company doesn’t come forward to help any to the grieving family.
